1. Facing Financial Difficulties

When you're struggling to pay your debts and bills, you might consider entering the debt review process. This is especially helpful if you have multiple debts and you're finding it hard to manage monthly repayments in favour of creditors

image

2. Applying for Debt Review

You'l reach out to a registered debt counsellor. This is a person or company authorized by the National Credit Regulator (NCR) to help you with your debt situation. The counsellor will help you gather information about your debts, income, and expenses.

image

3. Assessment by the Debt Counsellor

The debt counsellor takes a close look at your financial situation to determine whether you're overindebted, meaning you can't afford to pay all your debts on time. If you are indeed over-indebted, they will proceed with the debt review process.

image

4. Notifying Creditors and Credit Bureaus

The debt counsellor contacts all your creditors (the companies or people you owe money to) and lets them know that you're undergoing debt review. They also inform the credit bureaus so that your credit report can be updated to show that you're under debt review.

image

5. Negotiating a Repayment Plan

The counsellor works with your creditors to come up with a new repayment plan that's more manageable for you. They might negotiate for lower interest rates, extended payment terms, or reduced monthly payments.

image

6. Court Confirmation

The repayment plan, is presented to a Magistrate's Court or National Consumer Tribunal to make it an order by court.

image

7. Making Payments

You'll make payments according to the new terms. You'll send your payments to a Payment Distribution Agency (PDA) appointed by the counsellor. The PDA then distributes the money to your creditors as agreed upon and you to receive proof of payment distribution in a prompt manner.

image

8. Staying on Track

You'll need to stick to the repayment plan diligently. It's important to pay on time every month. If your financial situation changes, you should inform your debt counsellor so they can adjust the plan if needed.

image

9. Clearing Your Debt

As you make consistent payments, you'll gradually pay off your debts according to the plan. Once all the debts in the plan are paid off, the counsellor will issue a clearance certificate. This confirms that you've fulfilled your obligations and can now move forward without the burden of those debts.
Remember that the debt review process is a serious commitment, and it's important to work closely with your debt counsellor and follow their guidance throughout the journey. It's designed to help you regain control of your finances and work towards a debt-free future.
